BDSM and The Law
Georgia
Sodomy laws have been repealed—or are ignored—in most
states, but not Georgia, where a man was sentenced to five years in
prison for engaging in oral sex. With his wife. With her consent. In
their home.
Sex is defined as :
16-6-2 Sodomy
"A person commits the offense of sodomy when he or she performs or submits
to any sexual act involving the sex organs of one person and the mouth or anus
of another."
16-12-100 Sexual Intercourse
Sexual intercourse, including genital-genital, oral-genital, anal-genital, or
oral-anal, whether between persons of the same or opposite sex.
The age of consent is 16 years old with penalties and definitions of various
crimes depending upon the relative ages of the parties are described in 16-6-3.

3-3-41 No sex acts in bars
No person shall perform on licensed premises acts of or acts which constitute or
simulate: sexual intercourse, masturbation, sodomy, bestiality, oral copulation,
flagellation, or any sexual acts which are prohibited by law; the touching,
caressing, or fondling of the breast, buttocks, anus, or genitals; or the
displaying of any portion of the female breast below the top of the areola or
the displaying of any portion of any person's pubic hair, anus, cleft of the
buttocks, vulva, or genitals."
16-6-2 Sodomy
"A person convicted of the offense of sodomy shall be punished by
imprisonment for not less than one nor more than 20 years."
16-6-8 Public indecency
"A person commits the offense of public indecency when he or she performs
any of the following acts in a public place: an act of sexual intercourse; a
lewd exposure of the sexual organs; a lewd appearance in a state of partial or
complete nudity; or a lewd caress or indecent fondling of the body of another
person."
16-6-9 Prostitution
"A person commits the offense of prostitution when he performs or offers or
consents to perform an act of sexual intercourse for money." This is a
misdemeanor.
16-6-10 Renting to prostitutes
"A person having or exercising control over the use of any place or
conveyance which would offer seclusion or shelter for the practice of
prostitution commits the offense of keeping a place of prostitution when he
knowingly grants or permits the use of such place for the purpose of
prostitution." This is "a misdemeanor of a high and aggravated
nature".
16-6-11 Pimping
"Offers or agrees to procure a prostitute for another.." This is
"a misdemeanor of a high and aggravated nature".
16-6-12 Pandering
"A person commits the offense of pandering when he or she solicits a person
to perform an act of prostitution in his or her own behalf or in behalf of a
third person or when he or she knowingly assembles persons at a fixed place for
the purpose of being solicited by others to perform an act of
prostitution." This is "a misdemeanor of a high and aggravated
nature".
16-6-15 Solicitation of Sodomy
"A person commits the offense of solicitation of sodomy when he solicits
another to perform or submit to an act of sodomy. ... a person convicted of
solicitation of sodomy shall be punished as for a misdemeanor."
16-6-16 Masturbation for hire
"... the offense of masturbation for hire when he erotically stimulates the
genital organs of another, whether resulting in orgasm or not, by manual or
other bodily contact exclusive of sexual intercourse or by instrumental
manipulation for money or the substantial equivalent thereof" is a
misdemeanor.
16-6-17 Guilt by association
"... to massage any person in any building, structure, or place used for
the purpose of lewdness, assignation, prostitution, or masturbation for
hire" is a misdemeanor.
16-6-18 Fornication
"An unmarried person commits the offense of fornication when he voluntarily
has sexual intercourse with another person and, upon conviction thereof, shall
be punished as for a misdemeanor."
16-6-19 Adultery
"A married person commits the offense of adultery when he voluntarily has
sexual intercourse with a person other than his spouse and, upon conviction
thereof, shall be punished as for a misdemeanor."
16-6-20 Bigamy
"A person commits the offense of bigamy when he, being married and knowing
that his lawful spouse is living, marries another person or carries on a
bigamous cohabitation with another person" ... "shall be punished by
imprisonment for not less than one nor more than ten years."
16-6-21 Marrying a bigamist
"An unmarried man or woman commits the offense of marrying a bigamist when
he marries a person whom he knows to be the wife or husband of another" ...
"shall be punished by imprisonment for not less than one nor more than ten
years."
16-12-80 Distribution of obscenity
"A person commits the offense of distributing obscene material when he
sells, lends, rents, leases, gives, advertises, publishes, exhibits, or
otherwise disseminates to any person any obscene material of any
description..." and is guilty of a misdemeanor of a high and aggravated
nature.
19-3-3.1 Same sex marriage
"It is declared to be the public policy of this state to recognize the
union only of man and woman. Marriages between persons of the same sex are
prohibited in this state."
36-60-3 Adult business zoning
"The governing authority of each county and municipal corporation is
authorized to enact, for their respective jurisdictions, ordinances which shall
have the effect of restricting the operation of adult bookstores, explicit media
outlets, and adult movie houses to areas zoned for commercial or industrial
purposes; provided, however, that no explicit media outlet or adult movie house
shall be located within 1,000 feet of any school building, school grounds,
college campus, public place of worship, or area zoned primarily for residential
purposes."
